PUBLIC INPUT AT BOARD MEETINGS:

In conformity with the Governor's Executive Order N-29-20 (March 17, 2020) and due to concerns over COVID-19, the Board meeting will be conducted entirely telephonically.

Members of the public who wish to offer public comment to the Board should submit written comments via Google form at https://bit.ly/DPWCommentForm or call +1 669 254 5252 and use Meeting ID No. 160 278 3583. Press # again when prompted for participant ID.


VOTING AND DISPOSITION OF ITEMS - Items require a majority vote of the entire membership of the Board (3 votes) for approval.

Any member of the Board may move to "reconsider" any vote on any item on the agenda, except to adjourn, suspend the Rules, or where an intervening event has deprived the Board of jurisdiction, providing that said member originally voted on the prevailing side of the item. The motion to "reconsider" shall only be in order once during the meeting, and once during the next regular meeting. The member requesting reconsideration shall identify for all members present the Agenda number, meeting date and subject matter previously voted upon. A motion to reconsider is not debatable and shall require an affirmative vote of three members of the Board.

The Board rules provide that all items adopted by the Board will not be distributed or presented to the Mayor, or other designated office, until the adjournment of the regular Board meeting following the date of the Board action. A motion to send an item "forthwith", if adopted by three (3) votes, suspends these rules and requires the Board Secretariat to forward the matter to the Mayor, or other office, without delay.

  1. FIND that this project is categorically exempt under Article III, Section 1, Class 3, Category 1, and Class 32 (infill) of the City's Environmental Quality Act Guidelines and there is no substantial evidence the proposed project will have significant effect on the environment and is in compliance with the California Environmental Quality Act (CEQA);

  2. FIND that none of the exceptions to the use of categorical exemption as set forth in Section 15300.2 of State CEQA Guidelines applies;

  3. SPECIFY that the Bureau of Street Services, Urban Forestry Division, located at 1149 South Broadway, is custodian of the documents or other material that constitute the record of proceedings upon which the Board's decision is based on; and

  4. REVIEW and APPROVE the request for a fee permit to remove 10 protected trees, which include four Coast Live Oak (Quercus Agrifolia) trees and six California Black Walnut (Juglans Californica) trees. Tree replacements are required.

Recommending the Board:

 

  1. FIND under the California Public Resources Code, Section 21166 and the State's Environmental Quality Act (CEQA) Guidelines Section 15162-15164, on the basis of substantial evidence contained in the whole record, that since the prior approval of the Negative Declaration (ND) State Clearing House No. 2017011017, there have been no changes to the project, changes with respect to the circumstances under which the project is being undertaken, or new information of substantial importance concerning the project, which cause new significant environmental effects or a substantial increase in the severity of previously identified significant effects, and therefore no subsequent ND, supplemental ND, or other analysis is required for the project;

  2. SPECIFY that the Bureau of Street Services, Urban Forestry Division located at 1149 South Broadway, is custodian of the documents or other material that constitute the record of proceedings upon which the Board's decision is based; and 

  3. APPROVE this fee tree removal permit request for three trees which include one Shamel Ash and two Indian Laurel Fig trees. Tree replacements are required.

Recommending the Board:

 

  1. APPROVE and FORWARD this report with transmittals to the Mayor requesting that the President or two members of the Board of Public Works be authorized to execute and award this contract to NBS for a database software that will complete the calculation of updated street lighting maintenance assessments for over 550,000 parcels and make recommended changes to Proposition 218 related documents to position the Bureau to conduct a citywide mail in ballot process. The total cost of the contract is $245,000; and

  2. AUTHORIZE the President or two commissioners to sign and execute the contract, upon approval of the Mayor's Office.
