PUBLIC INPUT AT BOARD MEETINGS:

An opportunity for the public to address the Board on public interest items will be provided for up to two (2) minutes per person for a cumulative total of twenty (20) minutes. Testimony shall be limited in content to matters which are within the subject matter jurisdiction of the Board. The Board may not take any action on matters discussed during the Public Comment period.

The Board will also provide an opportunity for the public to address the Board on agenda items before or during consideration of the item for up to two (2) minutes per person for a cumulative total of up to ten (10) minutes.

In conformity with the Governor's Executive Order N-29-20 (March 17, 2020) and due to concerns over COVID-19, the Board meeting will be conducted entirely telephonically.

Members of the public who wish to offer public comment to the Board should submit written comments via Google form at https://bit.ly/DPWCommentForm or call +1 669 254 5252 and use Meeting ID No. 161 637 1032. Press # again when prompted for participant ID.

VOTING AND DISPOSITION OF ITEMS - Items require a majority vote of the entire membership of the Board (3 votes) for approval.

Any member of the Board may move to "reconsider" any vote on any item on the agenda, except to adjourn, suspend the Rules, or where an intervening event has deprived the Board of jurisdiction, providing that said member originally voted on the prevailing side of the item. The motion to "reconsider" shall only be in order once during the meeting, and once during the next regular meeting. The member requesting reconsideration shall identify for all members present the Agenda number, meeting date and subject matter previously voted upon. A motion to reconsider is not debatable and shall require an affirmative vote of three members of the Board.

The Board rules provide that all items adopted by the Board will not be distributed or presented to the Mayor, or other designated office, until the adjournment of the regular Board meeting following the date of the Board action. A motion to send an item "forthwith", if adopted by three (3) votes, suspends these rules and requires the Board Secretariat to forward the matter to the Mayor, or other office, without delay.

  1. AUTHORIZE the Director of the Bureau of Sanitation to distribute and advertise the transmitted RFQ for the purpose of establishing a prequalified list of Ozonation and Biologically Activated Carbon Filtration (O3/BAC) System Package Suppliers to be included in the specifications/bid documents for the Los Angeles Glendale Water Reclamation Plant (LAGWRP) Advanced Water Purification Demonstration Facility (AWPDF);

  2. EVALUATE and QUALIFY the respondents based on requirements set forth in the RFQ and develop a recommended list of prequalified O3/BAC System Package Suppliers to be included in the specifications/bid documents for the LAGWRP AWPDF Project;

  3. DISTRIBUTE and ADVERTISE the transmitted RFQ for the purpose of establishing a prequalified list of Membrane Filtration (MF) System Package Suppliers to be included in the specification/bid documents for the LAGWRP AWPDF Project;

  4. EVALUATE and QUALIFY the respondents based on requirements set forth in the RFQ and develop a recommended list of prequalified MF System Package Suppliers to be included in the specifications/bid documents for the LAGWRP AWPDF Project;

HEARING APPEAL - SEWER SERVICE CHARGE RESIDENTIAL ADJUSTMENT - 3930 ROYAL OAK PLACE

 

Recommending the Board:

 

  1. DENY the appeal of the Bureau of Sanitation determination that limited the refund of Sewer Service Charges to one year prior to the adjustment request. Bureau of Sanitation's determination was based on the California Government Code section 911.2 (a) which states in relevant part:

 

a. A claim relating to any other cause of action shall be presented as provided in Article 2 (commencing with Section 915) not later than one year after the accrual of the cause of action. Case law has interpreted the section to mean that a claimant can only recover the damages for the past year immediately prior to the date of the claim.

SMALL BUSINESS PROCUREMENT - COMMUNITY-LEVEL CONTRACTING

 

Recommending the Board:

 

  1. INSTRUCT the Bureaus of Public Works to conduct an evaluation on their contracting opportunities to determine if it is an appropriate candidate as a Community-Level Contracting opportunity; and, the findings being included in the project reports being submitted to the Board of Public Works;

  2. INSTRUCT the Bureau of Contract Administration to provide guidance to assist the Bureaus in creating implementation strategies, plans, and evaluation methodologies for Community-Level Contracting;

  3. INSTRUCT the Bureaus of Public Works to provide a quarterly Community-Level Contracting report to the Board of Public Works showing the results of their Community-Level Contracting efforts;

  4. REQUEST the Chief Procurement Officer to include the Community-Level Contracting efforts into the overall strategy of the technologies being developed to manage City procurement activities;

  5. ENCOURAGE that City Departments, not subject to the review of the Board of Public Works, adopt the Community-Level Contracting into their contracting operations, thereby making City's contracting opportunities available to the most disadvantaged businesses in our region.

PROTECT-IN-PLACE HEALTHY MATURE TREES - STAGE IMPACTS FROM DEVELOPMENT PROJECTS

 

Recommending the Board:

 

  1. INSTRUCT the Bureau of Street Services in consultation with the City Forest Officer to report back in 60 days with recommended policy amendments language to the Board's 2015 Street Tree Removal Policy to protect-in-place healthy mature trees that might otherwise be damaged or removed during the process of staging for the construction of a building.
