BASIC CITY COUNCIL MEETING RULES

 

AGENDAS - The City Council meets Tuesday, Wednesday and Friday at 10:00 A.M. The agendas for City Council meetings contain a brief general description of those items to be considered at the meetings. Council Agendas are available in the Office of the City Clerk, Council and Public Services Division, Room 395, City Hall, 200 North Spring Street, Los Angeles, CA 90012, and on the Citys World Wide Web Home Page site on the Internet at www.lacity.org; click on Council Calendar.

 

Ten (10) members of the Council constitute a quorum for the transaction of business. The Council may consider an item not listed on the Council Agenda only if it is determined by a two-thirds (10) vote that the need for action arose after the posting of an Agenda. Some items on the Agenda may be approved without any discussion, however any item may be called special by a Councilmember. If an item is called special it will be held until the remainder of the items on the Council agenda have been acted on by the Council. An item may also be called special if a member of the public has requested to speak on the item and a public hearing has not previously been held on the matter.

 

The City Clerk will announce the items to be considered by the Council, however items will be grouped. For example, all items for which required public hearings have not previously been held are listed in one section on the printed Agenda. The Council President will ask if any Councilmember or member or the public wishes to speak on one or more of these items. If anyone wishes to speak on an item, it will be called special. The remaining items in this section will be voted on by Council with one roll call vote.

 

PUBLIC INPUT AT CITY COUNCIL MEETINGS - An opportunity for the public to address the Council on agenda items for which public hearings have not been provided will be provided before or during consideration of the item. Members of the public who wish to speak on any item are requested to complete a speaker card for each item they wish to address, and present the completed card(s) to the Sergeant-At-Arms. Speaker cards are available at the back of the Council Chamber.

 

The Council will also provide an opportunity for the public to speak on public interest items for a cumulative total of up to ten (10) minutes. Testimony shall be limited in content to matters which are within the subject matter jurisdiction of the Council. The City Council may not take any action on matters discussed during the public testimony period.

 

COUNCIL DISCUSSION AND TIME LIMITS - Councilmembers requesting to address the Council will be recognized by the Council President in the order requested. For any item, the Chairperson of the Committee, or the maker of the original motion, or the member calling a matter special shall have up to six (6) minutes to discuss the item. All other Councilmembers may speak up to three (3) minutes each on the matter. After all members desiring to speak on a question have had an opportunity to be heard once, the time for each Member desiring to speak again shall be limited to a maximum of three (3) minutes.

 

A motion calling the previous question may be introduced by any member during a Council debate. If adopted, this motion will terminate debate on a matter and the Chair will instruct the Clerk to call the roll on the matter.

 

VOTING AND DISPOSITION OF ITEMS - Most items require a majority vote of the entire membership of the Council (8 members). Items which have not been discussed in a Council Committee and have been placed directly on the Council Agenda will require 10 votes to consider. Once considered, these items will normally require eight (8) affirmative votes to be adopted. Ordinances require a unanimous vote (at least 12 members must be present) in order to be adopted on first consideration. If an ordinance does not receive the necessary unanimous vote, it is laid over one calendar week. The votes required for approval on second consideration vary and depend upon the type of ordinance, but a typical ordinance requires eight (8) affirmative votes upon second consideration.

 

When debate on an item is completed, the Chair will instruct the Clerk to call the roll. Every member present must vote for or against each item; abstentions are not permitted. The Clerk will announce the votes on each item. Any member of Council may move to "reconsider" any vote on any item on the agenda, except to adjourn, suspend the Rules, or where an intervening event has deprived the Council of jurisdiction, providing that said member originally voted on the prevailing side of the item. The motion to "reconsider" shall only be in order once during the meeting, and once during the next regular meeting. The member requesting reconsideration shall identify for all members present the Agenda number, Council file number and subject matter previously voted upon. A motion to reconsider is not debatable and shall require an affirmative vote of eight members of the Council.

 

When the Council has failed by sufficient votes to approve or reject an item, and has not lost jurisdiction over the matter, or has not caused it to be continued beyond the next regular meeting, the issue is again placed on the next agenda for the following meeting for the purpose of allowing the Council to again vote on the matter.

 

The City Council rules provide that all items adopted by the Council will not be presented to the Mayor, or other designated officer by the City Clerk until the adjournment of the regular Council meeting following the date of the Council action. A motion to send an item forthwith if adopted by ten (10) votes, suspends these rules and requires the City Clerk to forward the matter to the Mayor, or other officer, without delay.

 

RULE 16 MOTIONS - Council Rule No. 16 allows a member to send an item directly to the Council without it having to go to a Council Committee first, by giving the City Clerk a motion (seconded by an additional member) during a Council session to be placed on the next regular available Council Agenda.

Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

PRESENT and ADOPT the accompanying ORDINANCE amending the City=s CTD Ordinance provisions in the Los Angeles Administrative Code, which established procedures for creating community taxing districts to fund certain public or private capital facilities and services that provide public districts.

2.    INSTRUCT the City Treasurer to work with the City Administrative Officer (CAO) relative to any recommended actions for the Council to implement to better plan for General Fund borrowing.

BUDGET AND FINANCE COMMITTEE REPORT relative to false alarm billings.

 

Recommendations for Council action, as initiated by Motion (Greuel - Hahn):

 

1.    INSTRUCT the Office of Finance (OOF) to work with the Los Angeles Police Department (LAPD), Controller, City Administrative Officer (CAO) and Chief Legislative Analyst (CLA) to report back to the Council within 90 days with an evaluation on the current failures of the existing collections system, full cost recovery fee analysis with recommended system improvement and enhancements. The report should include, but not be limited to: research and findings developed from the 2003 Burglar Alarm Task Force; a feasibility study on reassigning the billing and collection responsibilities from the LAPD to any one of the following: OOF, private contract services, the alarm companies and other government entities with better collection services.

 

2.    REQUEST the City Attorney to report to the Council on the Citys legal authority to pass an ordinance holding alarm monitoring companies or alarm companies responsible for their subscribers false alarm billings and initial permit fees.

 

Fiscal Impact Statement: Neither the CAO nor the CLA have submitted a financial analysis of this report.

Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE

APPROVE the refund claim filed by ExxonMobile Oil Corporation for overpayment of business tax in the not-to-exceed amount of $112,082.60.

BUDGET AND FINANCE COMMITTEE REPORT relative to removal of uncollectible accounts receivable of $1,000 or more from the Department of General Services (GSD) accounts.

 

Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

APPROVE the Board of Review recommendation to remove from the active accounts receivable of the GSD, an invoice totaling $14,000.

 

Fiscal Impact Statement: The Board of Review reports that the proposed action will result in a decrease in the Citys receivable base by $14,000. The related account has exceeded the four-year statute of limitations.

BUDGET AND FINANCE COMMITTEE REPORT relative to a refund claim filed by First American Title Insurance Company for overpayment of Real Property Transfer tax.

 

Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

APPROVE the refund claim filed by First American Title Insurance Company for overpayment of Real Property Transfer tax in an amount not to exceed $123,305.71.

BUDGET AND FINANCE COMMITTEE REPORT relative to preparation of a fiscal contingency plan.

 

Recommendations for Council action, as initiated by Motion (Parks - Greuel - Garcetti):

 

1. INSTRUCT the City Administrative Officer (CAO) and the Chief Legislative Analyst (CLA) to:

 

a. Commence preparation of a fiscal contingency plan, as a potential response to drastic reductions in City revenues that could hit the City in the near future. The plan should be submitted for consideration in conjunction with the Mid-Year report to be released in early January 2008. The plan should include detailed recommendations for extraordinary budgetary controls to be implemented March 1, 2008, that will maintain key City services while balancing the City Budget and restoring the Reserve Fund to prudent levels.

 

b. Work together to develop, as part of the Citys Financial Policies, clear and concise re-opener language for all Memorandums of Understanding addressing potential economic downturn/financial uncertainties and/or declared financial emergencies.

2. INSTRUCT the Personnel Department to immediately commence preparation of potential lay off lists for implementation, as necessary.

 

Fiscal Impact Statement: Neither the CAO nor the CLA have completed a financial

analysis of this report.

 

 

ITEM NO. (8)

BUDGET AND FINANCE COMMITTEE REPORT relative to a request to allow the Board of Animal Services to evaluate and set fees.

 

Recommendations for Council action:

 

1.    RECEIVE and FILE the Animal Services Department (ASD) report relative to a request for an ordinance to allow fees to be evaluated and set by the Board of Animal Services inasmuch as the Department needs to complete its fee analysis relative to full cost recovery, and submit a fee waiver policy for Council consideration.

 

2. INSTRUCT the ASD to report back to the Budget and Finance Committee within 60 days relative to:

a. Analysis of the Departments fees and charges, with recommendations for fee adjustments to enable full cost recovery, and criteria or policies for fee waivers;

 

b. All strategies the Department is using to increase dog registrations and adoptions.

 

Fiscal Impact Statement: The City Administrative Officer reports there is no General Fund impact.

EDUCATION AND NEIGHBORHOODS COMMITTEE REPORT relative to the filing of Council files by Neighborhood Councils and the role of the Department of Neighborhood Empowerment (DONE).

 

Recommendations for Council action:

 

1. APPROVE the recommendation that the City shall facilitate the filing of Council files by Neighborhood Councils, with the following provisions: 1) This shall be a two-year pilot project; 2) Neighborhood Councils may submit up to three Council files per calendar year; 3) a Council file submission requires the support of a second Neighborhood Council; and, 4) these files will be identified as Neighborhood Council Files (NCFs). [Recommendation No. 3 of the Neighborhood Council Review Commission Final Report dated September 25, 2007 (NCRC Final Report), as amended by Committee action]

 

2. INSTRUCT the City Clerk, Chief Legislative Analyst (CLA), and the DONE to develop procedures and guidelines that would establish a uniform submission process of NCFs in order to begin on May 1, 2008.

 

3.    APPROVE the recommendation that DONE shall have as its primary role one that is facilitative and supportive to Neighborhood Councils. [Recommendation No. 18 of the NCRC Final Report]

 

Fiscal Impact Statement: None submitted by the NCRC. Neither the City Administrative Officer nor the CLA has completed a financial analysis of this report.

 

Community Impact Statements: On April 14, 2005, the Northwest San Pedro Neighborhood Council passed a motion supporting the idea of creating a mechanism whereby Neighborhood Councils can file Council files and therefore supports NCRC Recommendation #3.

 

On December 5, 2007, the Van Nuys Neighborhood Council (VNNC) discussed and approved supporting the NCRCs Recommendation #73 which states that, The City shall, within seven years, appoint a commission to examine the progress of the NC system in light of the recommendations of the NCRC. VNNC believes that the best development of the NC system is assured when we make carefully considered, periodic evaluations of our activities. In fact, VNNC recommends that we repeat this process every 5 years.

 

At its Board of Directors Meeting of December 5, 2007, the Van Nuys Neighborhood Council (VNNC) discussed and overwhelmingly approved the following motion: VNNC supports the NCRCs Recommendation #10 which re-ratifies and facilitates the handling of CISs. It allows alternative methods for those NCs who do not wish to and cannot submit electronic submissions. A combined effort from the NCs should accompany DONEs efforts to inform and educate the NCs in the value and techniques of CISs.

PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to funding to complete Pilot Surveys for SurveyLA, the Citywide Los Angeles Historic Resources Survey project.

 

Recommendation for Council action:

 

APPROVE funding in the amount of $100,000 from the Construction Services Trust Fund No. 438/50, for the Department of City Planning to hire historic preservation consultants to complete pilot surveys for the SurveyLA project, the Citywide Los Angeles Historic Resources Survey project.

 

Fiscal Impact Statement: The City Administrative Officer reports that the source of the funds is the Construction Services Trust Fund, which has sufficient funds to finance this eligible request. This expenditure is in compliance with the Citys Financial Policies.

GENERAL EXEMPTION and TRANSPORTATION COMMITTEE REPORT relative to the establishment of Overnight Parking District (OPD) No. 513 northeast of Saticoy Street and Woodley Avenue.

 

Recommendations for Council action:

 

1.    FIND that the establishment of OPD No. 513, pursuant to Los Angeles Municipal code (LAMC) Section 80.54, is exempt from the California Environmental Quality Act (CEQA) under the General Exemption (Article II, Section 1, of the 2002 Los Angeles City CEQA Guidelines).

 

2.    ADOPT the accompanying RESOLUTION establishing OPD No. 513, pursuant to LAMC Section 80.54 to include all street segments within the area bounded on the north by Roscoe Boulevard, on the east by the San Diego Freeway, on the south by Saticoy Street, and on the west by Woodley Avenue with both sides of the northerly, southerly and westerly boundary streets to also be included in OPD No. 513.

 

3.    AUTHOIRZE the following restriction for use in all of OPD No. 513:

 

TOW AWAY NO PARKING 2 AM TO 6 AM

 

4.    REQUIRE that the Los Angeles Police Department should have the primary responsibility for the enforcement of the authorized overnight parking restriction in OPD No. 513, with the support from the Los Angeles Department of Transportation (LADOT) Parking Enforcement, since the reported problems involve criminal activity.

 

5.    DIRECT the LADOT to post the authorized overnight parking restriction signs on the following streets within OPD No. 513, except for areas where parking is currently prohibited at all times in the interest of traffic flow or safety or where there are existing parking prohibitions that encompass the 2 AM to 6 AM time period, upon Council establishing OPD No. 513:

 

a.    Both sides of Strathern Street between Gloria Avenue and Aqueduct Avenue

 

b.    The north side of Blythe Street between Woodley Avenue and Gloria Avenue

 

c.    The south side of Blythe Street between Gaviota Avenue and Gloria Avenue

 

d.    Both sides of Arminta Street between Woodley Avenue and the dead end east of Gloria Avenue

 

e.    Both sides of Stagg Street between Gloria Avenue and Aqueduct Avenue

 

f.     Both sides of Woodley Avenue between Daily Drive and Saticoy Street

 

g.    Both sides of Gaviota Avenue between Blythe Street and Arminta Street

 

h.    Both sides of Gloria Avenue between Strathern Street and Saticoy Street

 

i.      Both sides of Densmore Avenue between Stagg Street and Saticoy Street

 

j.      The west side of Aqueduct Avenue between Strathern Street and Staff Street

 

k.    Both sides of Aqueduct Avenue between Stagg Street and the dead end south of Stagg Street

 

6.  AUTHORIZE the LADOT to install or remove the authorized OPD No. 513 parking restriction signs on any of the street segments within OPD No. 513, except for areas where parking is currently prohibited at all times in the interest of traffic flow or safety, upon written instructions from the affected Council District requesting the installation or removal of such signs following Council action establishing the District.

 

7.  DIRECT the LADOT to prepare a Notice of Determination reflecting the Council=s actions under Recommendation No. 1 above and file such notice with the City and County Clerks within five working days of the City Council=s action.

 

Fiscal Impact Statement: The LADOT reports that all costs of the Overnight Parking Program are intended to be fully supported by fees charged for Overnight Parking Permits, or from other contributions. Since there will be no Overnight Parking Permits for OPD No. 513 and no other contributions have been identified, the cost of parking restriction sign installation will have to be absorbed by the DOT General Fund Budget for Fiscal Year 2007-08. However, the City may gain additional General Fund revenue from the issuance of parking citations to violators of the OPDs parking restrictions.

NEGATIVE DECLARATION and TRANSPORTATION COMMITTEE REPORT relative to the establishment of Overnight Parking District (OPD) No. 528 for Portner Street and Bushwick Street adjacent to the Glendale Freeway in Glassell Park.

 

Recommendations for Council action:

 

1.  FIND that the establishment of OPD No. 528 will not have a significant impact on the environment, pursuant to the Citys Environmental Guidelines and in compliance with the California Environmental Quality Act; that the Negative Declaration reflects the independent judgment of the lead agency, the City of Los Angeles, that the documents constituting the record of proceedings in this matter are in the custody of the City Clerk and in the files of the Los Angeles Department of Transportation (LADOT) in the custody of the Preferential Parking Section.

 

 

2.  FIND that the area bounded by the north side of Avenue 36, the west side of Eagle Rock Boulevard, the east side of Verdugo Road, the north side of Cypress Avenue, the centerline of Division Street, the south side of San Fernando Road, and the west side of Fletcher Avenue, including both sides of Portner Street between Avenue 36 and Estara Avenue, and Bushwick Street between Avenue 36 and Estara Avenue, is developed with a mix of single-family and multi-family residential dwelling units which lack adequate parking and whose residents depend upon being able to park on the street adjacent to their homes.

 

3.  ADOPT the accompanying RESOLUTION establishing OPD No. 528, pursuant to Los Angeles Municipal Code (LAMC) Section 80.54 to include the area described above in Recommendation No. 2.

 

4.  AUTHOIRZE a No Parking, 2 AM to 6 AM; District No. 528 Permits Exempt overnight parking restriction for the east side of Portner Street between Avenue 36 and Estara Avenue, for the west side of Bushwick Street between Avenue 36 and Estara Avenue, and for any other street segments within OPD No. 528 where the frontage is developed with residential units of a public park on one of both sides.

 

5.  AUTHORIZE a No Parking, 2 AM to 6 AM overnight parking restriction for any street segment within OPD No. 528 where there is no residential or park frontage on either side of the street.

 

6.  REQUIRE that the Los Angeles Police Department should have the primary responsibility for the enforcement of the authorized overnight parking restriction in OPD No. 528, with the support from LADOT Parking Enforcement, since the reported problems involve criminal activity.

 

7. INSTRUCT the LADOT to initiate the necessary procedures to prepare, issue and collect payments for Overnight Parking Permits from the residents of OPD No. 528 in accordance with LAMC Section 80.54, where the following permit conditions will apply:

 

a. Maximum of three Resident Permits per dwelling unit at $15 per year.

 

b. Maximum of two Visitor Permits per dwelling unit at $10 per four months.

 

c. Maximum of 25 Guest Permits per dwelling unit per day at $1 per day.

 

d. Issuance of more than 25 one-day Guest permits for the same calendar day to a single dwelling unit shall require submittal to LADOT of prior written approval of the Council District in which the permit requestor resides.

 

8. DIRECT the LADOT to post the authorized No Parking, 2 AM to 6 AM; District No. 528 Permits Exempt overnight parking restriction signs along the following street segments, except for areas where parking is currently prohibited at all times in the interest of traffic flow or safety, upon Council action establishing OPD No. 528:

 

a.    Portner Street between Avenue 36 and Crestmoore Place (east side only)

 

b.    Portner Street between Crestmoore Place and Avenue 35 (east side only)

 

c.    Portner Street between Avenue 35 and Avenue 34 (east side only)

 

d.    Portner Street between Avenue 34 and Estara Avenue (east side only)

 

e.        Bushwick Street between Avenue 36 and Crestmoore Place (both sides)

 

f. Bushwick Street between Crestmoore Place and Avenue 35 (west side only)

 

g.        Bushwick Street between Avenue 35 and Avenue 34 (west side only)

 

h.        Bushwick Street between Avenue 34 and Estara Avenue (west side only)

 

9. Fiscal Impact Statement: The LADOT reports that OPDs with permits for residents and their guest are considered a special service, and the City is entitled to fully recover the costs of administering, posting, maintaining and enforcing these OPDs through the fees charged for permits. At this time, the annual cost of this special service is unknown but it is expected to be somewhat less than the cost of the Preferential Parking Program. Therefore, the City Attorney has recommended that the LADOT set the initial OPD permit fees at a level of approximately two-thirds of the current Preferential Parking District fees. A cost analysis of the Overnight Parking Program is planned following the end of the 2006-07 Fiscal Year, after the Overnight Parking Program has been in effect for about one year and the permit fees will be adjusted accordingly based on the results of that analysis. In addition to recovering the full cost of the Overnight Parking Program from permit fees, the City may gain additional General Fund revenue from the issuance of parking citations to violators of the OPDs parking restrictions.

Recommendations for Council action:

 

1. FIND that this project is categorically exempt from the California Environmental Quality Act of 1970 pursuant to Article III, Class 5(5) of the City's Environmental Guidelines.

 

2. FIND that this acceptance of the Irrevocable Offer of Dedication of land is in substantial conformance with the General Plan pursuant to Sections 556, 558, and 559 of the Los Angeles City Charter.

 

3. ADOPT the City Engineer report dated December 19, 2007 and the accompanying RESOLUTION OF ACCEPTANCE of Irrevocable Offer of Dedication of land located along 2608 North Hargrave Drive.

 

4. AUTHORIZE the Real Estate Section, Bureau of Engineering, to record the Resolution with the Los Angeles County Recorder.

 

Fiscal Impact Statement: The City Engineer reports that the applicant has paid a Dedication Fee in the amount of $1,926 for processing this Irrevocable Offer of Dedication. This includes a fee to provide for the cost of processing the real estate transfer documents in the amount of $1,800 and a seven percent surcharge in the amount of $126 in accordance with Sections 12.37 and 61.03 of the Los Angeles Municipal Code respectively. No additional funds will be required from the General Fund for the processing of this request.

1.    INSTRUCT the Bureau of Street Services to prepare a contract, agreement or other necessary document with both the Para Los Ninos for the purchase of six SAFE Zone signs, and Its a Blast, Inc., for street and sidewalk pressure washing in the Central City East (Skid Row) Area on December 7, 2007, subject to the approval of the City Attorney as to form and legality.

 

2.    AUTHORIZE Council District 14 to execute a contract or other necessary document with both the Para Los Ninos, in the amount of $1,100 for the purchase of the above SAFE School Zone signs, and Its a Blast, Inc., in the amount of $4,620 for pressure washing in the Area indicated above. Said contract, agreement or other necessary document shall include, but not be limited to, the following: Description of the work to be performed; the estimated completion date; and a detailed accounting of the expenditures to the Board of Public Works, Office of Accounting, within 30 days of completion of the work to be performed.

 

3.    AUTHORIZE the Board of Public Works, Office of Accounting, and Controller, as appropriate, to issue payment/transfer up to $5,720 from the Council District 14 portion of the Street Furniture Revenue Fund No. 43D/50, to the (1) Para Los Ninos - $1,000; and, (2) Its a Blast, Inc. - $4,620 for the work described above.

 

4.    INSTRUCT the Bureau of Street Services, with the assistance of the Board of Public Works, Office of Accounting, to ensure compliance by both entities with the above accounting requirements.

Recommendations for Council action:

 

1. ADOPT a policy that instructs all Council Offices to approve street furniture siting permit requests which have been submitted by the contractor, or mutually agreeable alternate sites, in such numbers sufficient to meet the AProjected Roll-Out Schedule@ as detailed in Appendix 2 of Contract No. C-102477 as determined by the contract administrator, Director, the Bureau of Street Services (BOSS) or designee; and further, ADOPT a policy that prior to April 20, 2007, Council will approve outstanding permit requests to bring the City into compliance with said Projected Roll-Out Schedule.

 

2. INSTRUCT the BOSS and Chief Legislative Analyst (CLA) to report to Council by February 2008 with a status report on the siting permits approved by the Council Districts.

 

3. INSTRUCT the BOSS and CLA to report to Council with a list of outstanding permit requests needed to fulfill the Projected Roll-Out Schedule for approval by Council, in sufficient time to allow the Council to consider this matter prior to April 30, 2008.

 

4. AUTHORIZE the BOSS, CLA and City Attorney to negotiate with CBS Decaux if there are opportunities with regard to extending the timing or approvals for street furniture siting permits in exchange for the flexibility in regard to an extension of the escrow period by the contractor for a commensurate period.

 

Fiscal Impact Statement: The CLA reports that approval of the balance of the number of siting permits for specific types of street furniture contemplated in the Projected Roll-Out Schedule contained in Contract No. 102477 for the Coordinated Street Furniture Program, prior to the close of the 2008 escrow period, is essential for the City to receive the Minimum Annual Fee in the total amount of $124 million over the remaining term of the existing contract.
